Oxygen Mobile ActiveX Control Software License Agreement

BEFORE PROCEEDING WITH THE INSTALLATION
AND/OR USE OF THIS SOFTWARE, CAREFULLY
READ THE FOLLOWING TERMS AND CONDITIONS
OF THIS LICENSE AGREEMENT AND LIMITED
WARRANTY (The Agreement).

BY INSTALLING OR USING THIS SOFTWARE YOU
INDICATE YOUR ACCEPTANCE OF THIS
AGREEMENT. IF YOU DO NOT ACCEPT OR AGREE
WITH THESE TERMS, YOU MAY NOT INSTALL OR
USE THIS SOFTWARE!
1. Introduction. This agreement explains when and how you may use both
Registered and Freeware Copies of Oxygen Mobile ActiveX Control.

In this agreement:

* Oxygen Mobile ActiveX Control means the Oxygen Mobile ActiveX Control
you have purchased or obtained for evaluation, including both the control
software and the associated documentation and other materials.

* Shareware Copy means a copy of Oxygen Mobile ActiveX Control
distributed by us or by our authorized agents for trial use with certain
functional limitations.

* Registered Copy means a fully functional copy of the Oxygen Mobile
ActiveX Control purchased from us or an approved vendor.

* we or us means Oxygen Software.

* you means the end user of Oxygen Mobile ActiveX Control.

* Commercial Application any application that will be distributed
to others for any kind of compensation or fee. This includes
shareware and other try before you buy as well as commercial
distribution methods.
* Developers license means Oxygen Mobile ActiveX Control file and lincese
key files designed for developing applications.
* Runtime license means a version of Oxygen Mobile ActiveX Control and
license key files designed for distribution of your applications.
2. Legal Agreement. This is a legal agreement which allows you, the end
user, to use Oxygen Mobile ActiveX Control under certain terms and
conditions. If you cannot agree to abide by the terms of this
agreement you should not use Oxygen Mobile ActiveX Control.

3. Copyright. Oxygen Mobile ActiveX Control is fully protected by copyright
and other laws and international treaty provisions.

4. Use of Oxygen Mobile ActiveX Control. You may use the Shareware Copy of
Oxygen Mobile ActiveX Control on as many computers as you like for an
unlimited time period to develop trial applications. If you have the
registered Oxygen Mobile ActiveX Control your use is subject to the
following restriction:

A. You may not redistribute controls derived from Oxygen Mobile ActiveX
Control without advanced written permission from Oxygen Software.

B. You agree to not distribute other controls total or partially based in
Oxygen Mobile ActiveX Control.

C. You agree to not modify the binary code for Oxygen Mobile ActiveX Control
and license files.

D. You are allowed to distribute only special run-time version of
Oxygen Mobile ActiveX Control with your applications.

E. You agree to treat the license for Oxygen Mobile ActiveX Control like a
book, negating the possibility that two people may use your
registered Copy simultaneously.

If you have the registered Oxygen Mobile ActiveX Control you may use
Oxygen Mobile ActiveX Control within your own Commercial Applications
or non-Commercial Applications provided the above restrictions are not
violated.

You assume full responsibility for the selection and use of
Oxygen Mobile ActiveX Control to achieve your intended results.

5. Making and Distributing Compiled applications based in
Oxygen Mobile ActiveX Control. You may use Developers license on several
personal computers with a limited nimber of phones. You may make copies of
your applications compiled with Oxygen Mobile ActiveX Control to give to
others with Runtime license only. You agree not to distribute applications
compiled with the Shareware copy or Developers license of Oxygen Mobile
ActiveX Control. You're not allowed to distribute developers license with or
without your applications.

6. Copying Registered Copies of Oxygen Mobile ActiveX Control. When you
receive a Registered Copy of Oxygen Mobile ActiveX Control you may make
copies of Oxygen Mobile ActiveX Control software which are necessary for
normal backup purposes. You agree not to make any other copies of the
software, or any part of them, or sell or give any copies to others,
without our advance written permission.
7. LIMITED WARRANTY: The following limited warranty applies to
Registered Copies of Oxygen Mobile ActiveX Control. It is included
here so you understand what your warranty will be when you
purchase a Registered Copy. This warranty does NOT apply to
Shareware Copies of Oxygen Mobile ActiveX Control.

Bugs and Program Errors. We do not promise that
Oxygen Mobile ActiveX Control will be free of bugs or program errors.
If you report a program error or bug to us, we will use our best
efforts to correct it. If we issue a maintenance release for
Oxygen Mobile ActiveX Control which includes a correction for an
error you reported, we will send you a copy of that maintenance
release at no charge if you request it. We will only do this for
maintenance releases, not for new major releases or other new
versions of Oxygen Mobile ActiveX Control.
8. Disclaimers and Limitations.

Disclaimer for Shareware Copies: You are not paying for the use
license for your Shareware Copy of Oxygen Mobile ActiveX Control.
Accordingly the Shareware Copy is provided AS-IS and without
warranty of any kind.

Disclaimer for Registered Copies: Except for the limited warranty
stated above, we disclaim any and all other warranties, express or
implied, oral or written, including any implied warranties of
merchantability or fitness for a particular purpose. The limited
warranty above gives you specific legal rights, but you may have other
rights, which vary from state to state.

Limitation of Liability: In no event shall we be liable for any
incidental, consequential, or punitive damages whatsoever arising out
of the use of Oxygen Mobile ActiveX Control or your relationship with us.
Some states do not allow exclusion or limitation of liability for
incidental or consequential damages, therefore the above limitation
may not apply to you.

CERTAIN JURISDICTIONS PROVIDE FOR GREATER RIGHTS THAN WHAT IS PROVIDED
INTHIS AGREEMENT. YOUR RIGHTS WITH RESPECT TO THIS AGREEMENT MAY VARY
DEPENDING ON YOUR JURISDICTION
